Terms & Conditions

Welcome to Isolation Performing Arts Studio (IPAS). Before enrolling your child to participate in any of our Programs, please take the time to read the following Rules, Terms and Conditions of enrolment.Once you have read the below, you will be directed to select a checkbox to confirm your agreement to the Rules, Terms and Conditions contained herein. By clicking the buttons at the bottom of the page, or authorising an IPAS representative to do so on your behalf, “I acknowledge and agree to the Rules Terms & Conditions”, “I acknowledge and agree to all policies”, “I acknowledge and agree to the Waiver of Liability” and “I acknowledge and agree to the Billing Authorisation”, you are signing an Agreement with IPAS to which you and your child are bound, until your child’s enrolment is withdrawn or terminated. By selecting the checkboxes referred to above, or authorising an IPAS representative to do so on your behalf, you agree to having read and understood the below terms and conditioned provided herein.We recommend that you obtain independent legal advice in the event that you require any clarification with respect to the below terms, or alternatively, please don’t hesitate to contact the Studio, as we are more than happy to assist you with any questions or queries you may have with respect to your child’s enrolment with us.

IPAS STUDIO PROGRAMS

IPAS programs run over the four Victorian State School terms, as set by the Department of Education and Training. For more information on IPAS term dates, please refer to your welcome email.

MEMBERSHIP FEES AND PAYMENTS

The total cost of enrolling your child in an IPAS program is calculated over the four school terms and your payments are split into 10 inclusive monthly payments, February to November. Your monthly payments will vary depending on the amount of tuition hours, classes selected and performance commitments. Our fee structure is listed on our website under the “about us” menu.

When you enrol your child to participate in an IPAS program, you are enrolling your child to participate in the program for the year, and are committing to making all payments, unless notice of withdrawal is received.

Monthly payments will be worked out on an individual basis and may include: all tuition fees, private lessons, concert costumes, elite team entries and extra rehearsals, registrations, insurances, end of year trophy and any additional resources. There are a few things we have not included in monthly payment due to the unknown such as exam fees and uniforms (we do not know who will present each year), elite team and solo costumes, solo entry fees.

The monthly payment is deducted from your nominated credit card/bank account each month. Generally, monthly payments will be debited on the 1st of each month (“the Charge Date”), however, IPAS reserves the right to vary the Charge Date at any time.

Even if your child does not attend all classes, you agree to pay the total term cost. You are encouraged to take advantage of our Flexible Make Up Class policy, with respect to any classes your child might miss.

Enrolment in our classes is by term, and as such, monthly payments may only be stopped at the end of any school term.

In the event of closure due to circumstances beyond our control, such as pandemic, for any period of  time, classes will move to online learning as immediately as possible. No refunds will be issued.

AUTOMATIC RE-ENROLMENT

Re-enrolment from term to term and year to year is an automatic procedure, which has been introduced by IPAS to reduce unnecessary administration each term, and to avoid any misunderstandings that may lead to a student missing out on a place in their usual class. Most of our students attend for numerous years in a row and many of our classes are full and have waiting lists.

When you enrol your child to participate in an IPAS program for a particular term, your child’s enrolment will continue for the next term, and the following term, and so forth, until you submit a Withdrawal of Enrolment form, notifying us that you wish to cancel your child’s enrolment. It is therefore very important that you read and consider the below policy with respect to withdrawing your child’s enrolment with our program/s.

WITHDRAWAL & CANCELLATION OF ENROLMENT

Re-enrolment from term to term is assumed and information will be sent out to parents towards the end of each year to re-enrol for the following year.

If you wish to cancel your child’s enrolment and you do not wish for your child to participate in our program for the next month, you must fill out and submit our Withdrawal of Enrolment form by the 15th of each month. (“the Withdrawal Cut-off Date”).

If we do not receive a Withdrawal of Enrolment form by the Withdrawal Cut-off Date, your child will stay enrolled automatically in our programs for the following month and you are bound to pay for the next month’s fees. Your child’s enrolment each term is automatic, and will continue until a Withdrawal of Enrolment form has been received by us.

If a student withdraws their enrolment before the end of a month, the current full month’s fees will still remain payable.

If you have confirmed your child’s participation in a performance opportunity (such as an exam, concert or eisteddfod) you are obligated to continue with monthly payments until the performance is complete. Extensive performance planning is carried out based on confirmed enrolments.

IPAS may reschedule or cancel classes at any time. If changes are made that affect your child’s ability to attend classes, IPAS will refund any outstanding fees within 30 days of receiving notice from you that your child will be unable to attend class as a result of the change in schedule.

Please note that any unpaid fees may result in the student being removed from our programs.

All costumes, uniforms, etc. will be released after the final inclusive direct debit payment in November. Any early withdrawals are not eligible to receive costumes, uniforms, etc.

TRIAL LESSON

IPAS offer trial lessons in all styles of classes, excluding private tuition. These are offered on an obligation free basis, rather than a free class. If the student decided to continue with the program their first class will be included within your inclusive monthly payments.

FLEXIBLE MAKE UP CLASSES

IPAS is proud to offer a flexible make-up policy for missed group classes. We are more than happy for students to attend a make-up lesson in an identical or similar class on a different day. It is the responsibility of the parent to identify the alternate class from our timetable (for example, a student who missed a Monday Junior Hip Hop class at Tullamarine, may attend the Wednesday Junior Hip Hop at Greenvale instead) and to email the studio to request a make-up lesson, we will let you know if we can accommodate your request.

Please note, make-up lessons are limited to two per student per term.

Make up lessons are not available for missed individual classes (private lessons) however, you are able to on-sell your private lesson time to another student, this can be done via the Private Lesson Facebook group. Please notify your teachers if you are going to be doing this.

SAFETY

We are committed to ensuring the safety and wellbeing of all our students and will endeavour to provide a safe and supportive environment for our students by:

  • treating our students with respect, understanding and by addressing their concerns as soon they arise
  • ensuring that all of our staff and volunteers hold current Working with Children Checks
  • enforcing a strict code of conduct for all of the IPAS community
  • providing clear dispute resolution mechanisms
  • making our child and youth risk management strategy available to all members of the IPAS community,
  • ensuring that our programs are engaging and age-appropriate for students
  • limiting the size of our programs, to ensure that teacher to student ratios are appropriate
  • creating an inclusive environment within our studio
  • creating a positive and supportive teaching program that encourages the emotional and social development of our students, and
  • providing a high level of ongoing support and training to our staff

Unacceptable behaviour and/or language will not be tolerated. IPAS reserves the right to refuse any student or parent that present a disciplinary problem to staff or a threat to the safety and wellbeing of other children or parents. Parents will be notified of inappropriate behaviour or such threat or problem upon IPAS becoming aware of same on one occasion only, and if unacceptable behaviour persists following such notice,  IPAS reserves the right to remove the student from the class. In these circumstances, a refund will not be available.

PARENTS’ CODE OF CONDUCT

By enrolling your child with IPAS, you agree to be bound by the Parents’ Code of Conduct. Parents have a responsibility to:

  • drop off and pick up children in a timely manner
  • alert IPAS of any concerns as soon as they arise
  • encourage your child to follow IPAS’s rules, and to work hard in class
  • never ridicule your child for making a mistake
  • respect decisions made by IPAS staff, especially with regard to selection, casting and placement
  • not force your child to participate in IPAS’s programs
  • take an interest in your child’s learning, and
  • respond to communication from the studio in a timely manner

Parents have the right to:

  • receive feedback on a student’s progress when requested
  • ask questions or raise concerns about IPAS’s programs, or student progress, and
  • have personal information treated confidentially, so that privacy is respected.

STUDENT CODE OF CONDUCT

Students have a responsibility to:

  • demonstrate a willingness to learn and participate in IPAS’s programs
  • behave appropriately, using acceptable language at all times
  • treat other students as they would like to be treated
  • report inappropriate behaviour, unsafe situations and harm to a member of staff, and
  • participate for their enjoyment and not just to appease their parents

Students have the right to:

  • feel safe, respected and understood
  • be included regardless of abilities
  • be listened to and to be able to ask questions if they don’t understand something
  • be involved in decisions that affect them
  • have their best interests considered, and
  • be free from harassment, bullying or abuse of any kind

TERMINATION OF ENROLMENT

You agree that in the event of a missed payment by you that is subsisting for more than 14 days, IPAS may terminate your child’s enrolment with our program/s. If IPAS terminate your child’s enrolment during any term, the full term’s fees will still be due and payable by you.

PRIVACY POLICY

IPAS is committed to safeguarding your privacy. The Privacy Act 1998 (Cth) governs the ways in which we must manage you and your child’s personal information.

When enrolling, enquiring or registering, as appropriate, you may be asked to enter your name, email address, mailing address, phone number, credit card information, information about your child or other details to help you with your experience at IPAS.

We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:

  • To provide feedback about how your child is progressing
  • To provide updates about events that your child is invited to participate in
  • To allow us to better service you in responding to your customer service requests
  • To quickly process your transactions
  • To send periodic emails regarding your order or other products and services
  • To follow up with you after correspondence (live chat, email or phone inquiries)

DISCLAIMER

You acknowledge that IPAS have used their best endeavours to ensure that the information contained herein is true and accurate but you acknowledge and agree that IPAS accepts no responsibility and disclaims all liability in the event of any error, misrepresentation or inaccuracy of such information.

You acknowledge having made your own enquiries with respect to the information contained herein prior to agreeing to be bound by these rules, terms and conditions.

 

WAIVER OF LIABILITY

PERSONAL INJURY/PROPERTY DAMAGE INDEMNITY

You warrant that your child is medically sound to undertake and participate in classes at IPAS. You hereby give consent for your child to participate in any and all programs and activities and you accept all risks associated with participation in our classes, workshops, or activities.

In consideration for your child’s participation, you agree that your child attends class at your sole risk and responsibility and you agree to indemnify IPAS and its employees, contractors, directors, volunteers and representatives from any liability, loss or damage or any other claim associated with the attendance of your child at IPAS classes, workshops or activities.

You agree to hold harmless, waive and release IPAS and its employees, contractors, directors, volunteers and representatives from liability as a result of personal injury or property damage occurring while your child are in attendance at an IPAS class, workshop or activity.

You agree that IPAS’ liability to you or any third party for any indirect or consequential loss, injury or damage suffered by you or your child, howsoever caused, as a result of any negligence, misrepresentation or otherwise, it limited to the amount of consideration paid by you for the services provided under this Agreement.

MEDIA INDEMNITY

Children may be filmed or photographed while participating in classes or studio activities. This material may be published in IPAS printed publications and online (including on the IPAS website and Facebook page). Images may also be supplied to third parties (e.g. Local newspapers) for promotional purposes.

If you do not wish your child to be filmed or photographed or used in publications or for media purposes, you must advise IPAS in writing prior to your child’s first class.

EMERGENCY MEDICAL TREATMENT INDEMNITY 

In the event of an accident or emergency, you hereby authorise and grant permission for IPAS and its employees, contractors, directors, volunteers and representatives to take whatever action may be necessary in the event of an emergency in the event that you or your child’s emergency contact person cannot be contacted, and you release and hold IPAS and its employees, contractors, directors, volunteers and representatives harmless in connection with any such action taken or for any omission made by IPAS.

Additionally, you hereby agree to indemnify IPAS for all medical expenses which may be incurred by IPAS as a result of an injury sustained by your child while participating in a IPAS class, workshop or other activity.

DISCLAIMER

You acknowledge that IPAS have used their best endeavours to ensure that the information contained herein is true and accurate but you acknowledge and agree that IPAS accepts no responsibility and disclaims all liability in the event of any error, misrepresentation or inaccuracy of such information. You acknowledge having made your own enquiries with respect to the information contained herein prior to agreeing to be bound by the Waiver of Liability.

BLLING AUTHORISATION

ACKNOWLEDGEMENT AND WARRANTIES

You acknowledge and agree that:-

  • Enrolment between terms and years is an automatic procedure and your child will be enrolled in the next term automatically unless Withdrawal of Enrolment form has been submitted by the Withdrawal Cut-off Date (refer to the Terms and Conditions section);
  • The Withdrawal of Enrolment form can be accessed here: https://goo.gl/forms/jdSnsVTDjZpnh0tD3
  • If you miss the Withdrawal Cut-off Date, billing will continue into the following month;
  • Re-enrolment information will be automatic from term to term and sent out towards the end of the current year, for the future year;
  • your credit card will be charged with 10 monthly payments (February – November) until such time as your child’s enrolment is terminated, withdrawn or cancelled in accordance with IPAS’s Terms and Conditions;
  • If you withdraw your child’s enrolment during the month, the full month’s fees are still payable;
  • You are responsible for the monthly payment whether or not your child attends class or not;
  • Any unpaid fees may result in your child being removed from our programs;
  • Should you dispute a debit made by IPAS through your financial institution, this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services provided by IPAS.

You warrant that:-

  • The credit card/bank details you have supplied are true and correct;
  • Any charges incurred by you will be honoured by your credit card company or financial institution; and
  • You will advise in writing immediately if there is a change to your credit card details.

You hereby authorise IPAS via this Ezidebit to:

  1. automatically debit your nominated credit card or bank account on the Charge Date (as varied) each month for the services provided by IPAS to you; and
  2. continue to debit your nominated credit card/bank account each month for 10 months (February – November) until such time as your child’s enrolment with IPAS is terminated or withdrawn, in accordance with the Terms and Conditions.

You understand that a Withdrawal of Enrolment form is required to terminate billing, and you are responsible for payment whether or not your child attends classes.

LATE PAYMENT FEES/ DEFAULT INTEREST

In the event that a debit is dishonoured, or you fail to pay any amount due and owing to IPAS by the due date, you agree to pay Default Interest to IPAS at 15% per annum for each day that the payment is overdue.

In the event that a payment due and owing to IPAS remains outstanding for a period of 30 days, IPAS may commence legal proceedings against you for recovery of the debt.

You agree to indemnify IPAS against any legal fees (on a client and solicitor basis) incurred by the IPAS in recovering payment of the debt from you, including any interest payable on the debt.
